Collection of Information
Information Collected or Received from You
Account Information. If you create an Account, we’ll collect certain information that can be used to identify you, such as your full name and email address (“PII”). You may also choose to add a profile picture to your Account by uploading or taking a picture. If you create an Account using your login credentials from one of your third-party social networking services such as Google, Facebook or Twitter (each, an “SNS Account”), you may grant us permission to access and collect certain information associated with your SNS account such as your name, username, email address, age, gender, profile picture, other information you make public in your SNS account (including geo-location), and, when you login through your Facebook account, Facebook friends and Facebook ID. We use this information in order to facilitate the login process, personalize your experience on the Services and provide you with products, services or features you request. You may be able to control what information you allow us to access in the preferences or settings of your SNS account. In addition, you can choose to make your SNS Account profile picture and name public within the Services to let other users know who you are, to connect with friends associated with your SNS account within the Services, and invite friends from your SNS account to join AmpMe.
Once you create your Amp Me account, you can choose to provide us with access to the phone number and/or email address of your device contacts so that we can help you to find and follow your friends that are using AmpMe. You can withdraw your consent to share this information with us at any time by adjusting your settings within the app or your device.
Information Collected Using Cookies and other Web Technologies. Like many website owners and operators, we use automated data collection tools such as Cookies and Web Beacons to collect certain information.
“Web Beacons” (also known as Web bugs, pixel tags or clear GIFs) are tiny graphics with a unique identifier that may be included on our Services for several purposes, including to deliver or communicate with Cookies, to track and measure the performance of our Services, to monitor how many visitors view our Services, and to monitor the effectiveness of our advertising. Unlike Cookies, which are stored on the user’s hard drive, Web Beacons are typically embedded invisibly on web pages (or in an e-mail).
Information Related to Use of the Services. Our servers automatically record certain information about how a person uses our Services (we refer to this information as “Log Data”), including both Account holders and non-Account holders (either, a “User”). Log Data may include information such as a User’s Internet Protocol (IP) address, other unique identifiers associated with a User’s SNS account or mobile device (e.g. device ID, Apple identifier for advertisers, or Facebook ID), browser type, operating system, other User device information (including device settings, model, platform, country, language, time zone, and name), the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, search terms, the links on our Services that a User clicked on, User settings associated with sharing Audio Content with other Users in the App (including whether a User has selected offline or private mode and permissions given to other Users), and other statistics. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize and enhance our Services by expanding their features and functionality and tailoring them to our Users’ needs and preferences. We may use a person’s IP address to generate aggregate, non-identifying information about how our Services are used. We may also use Log Data (include Log Data associated with your Apple identifier for advertisers) to personalize your experience and serve tailored ads on our Services and on third-party websites or applications.
We may also use services provided by third-party platforms (such as Facebook and other sites) to serve targeted ads on such platforms to you and/or others, and we may provide a hashed version of your email address or other unique identifier to the third party for such purposes. To opt-out of the use of your information for this type of advertising, contact us at the contact information set out below.
Third Party Services Account Information. Since AmpMe provides you with the functionality to amplify Audio Content to which you have permission to access, that you access via third party services (“Third Party Services”), we will collect information about you relating to your use of that Third Party Service such as which Audio Content you access or search for, on which Third Party Service, and your playlist if your Third Party Services account settings so permit.
Location Information. When you use our App, we may collect information about your location by converting your IP address into a rough geo-location or by accessing your device’s GPS coordinates or coarse location if you enable location services on your device.
Customer Service. If you contact us to report another User or an issue with the App, or otherwise provide feedback about your User experience, you may be asked for or provide us with information that identifies you (such as your name, email address, username) along with additional information we need to help us promptly resolve your issue or respond to your report, comment, or other feedback. We may retain this information to assist you in the future and to improve our customer service and product and service offerings.
Use of Information Collected
Our primary goals in collecting information are to provide and improve our Services, to administer your use of the Services (including your Account, if you are an Account holder), and to enable you to enjoy and easily navigate our Services. We will use your PII to:
● provide Services, communicate with you and provide customer support in relation to the Services.
● resolve disputes, collect fees (if any) and troubleshoot problems.
● customize your experience and otherwise measure and improve our Services.
● send you relevant emails, push notifications, and other communications (including keeping you informed about our products, offerings and any promotional offers) that might be of interest to you (If we use your personal information to market to you, you will be able to opt-out of such uses).
● enforce our agreements, terms, conditions, and policies, and send you notices and alerts.
Information that We Share with Third Parties
We will not share any PII that we have collected from or regarding you except as described below:
Information Shared with Our Services Providers. We may engage third-party services providers to work with us to administer and provide the Services. These third-party services providers have access to your PII only for the purpose of performing services on our behalf. The third-party services providers are : MixPanel, mLab, Tune, Fabrics, AWS, Google Cloud.
Information Shared with Third Parties. We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling and other similar purposes. Information Shared with other Users. Since you will be using the Services with your Friends/Speakers, we will share with your Friends/Speakers information about what Audio Content is being played and which of your Friends/Speakers’ devices are being used for playing such Audio Content. We also allow you to follow other Users/Friends/Speakers, invite other Users/Friends/Speakers to interact with and share Audio Content with you, and, when you are the Host, control which Users/Friends/Speakers have access to or are able to see such information and which such Users can add or contribute Audio Content. We make a chat function available within the App, which allows you to communicate with other Users/Friends/Speakers you interact with in the App. Any information you submit through this chat function is publicly available to other Users within the App.
Disclosed in Connection with Business Transactions. Information that we collect from our users, including PII, is considered to be a business asset. Thus, if we are acquired by a third party as a result of a transaction such as a merger, acquisition or asset sale or if our assets are acquired by a third party in the event we go out of business or enter bankruptcy, some or all of our assets, including your PII, may be disclosed or transferred to a third party acquirer in connection with the transaction.
Information Disclosed for Our Protection and the Protection of Others. We and our Canadian, US and other service providers may provide your personal information in response to a search warrant or other legally valid inquiry or order (which may include lawful access by Canadian, US or other foreign governmental authorities, courts or law enforcement agencies), to other organizations in the case of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise required or permitted by applicable Canadian, US or other law.
We offer you choices regarding the collection, use and sharing of your PII and we’ll respect the choices you make. Please note that if you decide not to provide us with the PII that we request, you may not be able to access all of the features of the Services.
Modifying Your Information. You can access and modify the PII associated with your Account by logging into your Account and modifying the PII. If you want us to delete your PII and your Account, please contact us at email@example.com with your request. We’ll take steps to delete your information as soon we can, but some information may remain in archived/backup copies for our records or as otherwise required by law.
Responding to Do Not Track Signals
Our Site does not have the capability to respond to “Do Not Track” signals received from various web browsers.
The Security of Your Information
We take reasonable administrative, physical and electronic measures designed to protect the information that we collect from or about you (including your PII) from unauthorized access, use or disclosure. If we request any sensitive information from you, we’ll encrypt this data and use SSL or other technologies. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.
Links to Other Sites
Your PII may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you’re located outside the United States and choose to provide your PII to us, we may transfer your PII to the United States and process it there.
Our Policy Toward Children
Our Services are not directed to children under 13 and we do not knowingly collect PII from children under 13. If we learn that we have collected PII of a child under 13 we will take steps to delete such information from our files as soon as possible.
Your California Privacy Rights
California residents may request and obtain from us, once a year, free of charge, a list of third parties, if any, to which we disclosed their PII for direct marketing purposes during the preceding calendar year and the categories of PII shared with those third parties.
